Muslim Divorce Effective From Husband’s Pronouncement: High Court
The Allahabad High Court ruled that under Muslim personal law, a husband’s lawful oral declaration of talaq makes the divorce effective from that date, not the later court decree. In a case where divorce was proclaimed in 2005 but formally decreed in 2013, the earlier talaq date was recognised, validating the woman’s subsequent second marriage.
